The process of buying or selling a property in Spain can be quite simple if you have the right legal advice, as there are some very important differences from the purchase process in other countries. In Spain, the purchase is not signed at a solicitor’s office, but in front of a Notary that witnesses and protocolizes the private contract. Without that, the purchase has no validity, and the property cannot be registered in your name, even if you have a private contract.

If you provide us with a power of attorney, we can complete all the steps without you having to be physically present, although of course we will never do anything without your written consent.

If you are buying a property , once you have put in an offer and it has been accepted, we check the vendor’s title deeds and if registered in his name and free of any mortgages, encumbrances, or other charges, so the property is purchased free of liabilities. We also do land registry and urban planning searches and public coastal domain conditions. If the property you are buying is under construction, we check off plan payments, vendor’s or promotor’s bank guarantees and can deal with the builder, architect, and planner if necessary.

We can also transmit and help you with a mortgage application and NIE (Foreign identification number) if you need to.

Once we have security on the purchase, we set the conditions, payments, date of attending to the Notary etc, always in defence of you interests, by drafting a private contract.

At the date of attending the Notary, we will sign on your behalf or if you are also attending you will sign yourself and we will attend to give you legal and translation assistance.

After that, we will pay the Notary fees and taxes, take the Deeds to the Land Registry to be registered in your name, and we will contract and arrange the direct debit of all the essential services, as water, electricity and council taxes in your name and will give you copies of all the documents, and explain all your liabilities as a new foreign owner of a property in Spain.

If you are selling your property, as well as the above described, we advise you about the potential capital gains taxes and deal with the necessary tax authorities.
